  • No criminal records: Applicants must be free of any criminal records or security concerns.
  • Education: It is a must prerequisite. In most cases, it is more beneficial to have at least a bachelor’s degree in the related field. Nevertheless, even without a diploma or other similar documents, documentary proof of technical qualifications, professional skills, accomplishments, and experience may still be sufficient basis.
  • Genuine Job: There is a real vacant job position in the employer’s workplace.
  • Employment Offer: You have secured a confirmed employment offer that will match either your academic qualifications or your work experience and that the job is not readily taken up by the local workforce.
  • Remuneration: The compensation package consisting of salary, housing, medical and other perks match the current market standards in Hong Kong.

Required Documents

Hong Kong Work Visa Requirements Documents required by the work visa applicants:

  • Duly filled Employment Visa Application Form
  • Photocopy of the personal details page of your passport. If presently in Hong Kong, include a photocopy of the passport page with the latest entry stamp or visa extension label.
  • Photocopy of your Hong Kong identity card (if applicable)
  • Photocopy of proof of residence abroad
  • Photocopy of academic certificates and relevant work experience documentation

Documents required by the employing company:

  • Employing Professionals in Hong Kong Application
  • The employment contract or letter of appointment of the company which will describe the post, salaries, other perks and the duration of employment.
  • The company’s Business Registration Certificate is also included in the package.
  • Submit the company’s recent audited financial report (or trading profit and loss account; or profit tax return) confirming its financial standing.
  • A document that describes the company background including business activities, mode of operation, the entrepreneur, affiliated companies, product ranges, markets, and supply sources with documentation from catalogs, brochures, etc. The document is not compulsory if the entrepreneur is sponsoring a non-local graduate.
  • If the company is newly founded within the last 12 months:
    • A management plan that covers financially sound information such as the source of funds, proposed capital injection, nature/mode of business activities, projected turnover, sales volume, gross and net profit, etc. plus the inclusion of proposed creation of local jobs.

Note:

The organization mentioned in the above document (except for the application form for employing professionals) should not be submitted by an employing agency that had successfully acquired an employment or training visa/permit for a non-local staff in the past 18 months before the submission of the application.

All submissions must be in English or in Chinese or translated into English or into Chinese by a certified translation body.

Immigration authorities may request additional documents from the applicant or employer as and when appropriate.

Hong Kong Work Visa Requirements, Application Procedure & Timeline

After the applicant and the employer have collected all the documents for the work permit application process, this submission must take place by mailing to the Hong Kong Immigration Department.

The time to process a work visa application is approximately 2-3 months.

If the outcome is positive the Immigration Department will issue the Visa/Entry Permit label which must be personally collected by the applicant or by an authorized representative for the applicant. The “Visa/Entry Permit” label should be affixed on a blank visa page of the applicant’s passport and he/she has to present it to the Immigration Officer as soon as they arrive in Hong Kong.

Normally, for the first time, work permit visas are given for one-year periods.

If an individual’s application for a work permit is denied, she can file an appeal with the relevant authorities.

Employment Visa Renewal

Work permit holders can apply for renewal by filing the renewal application at least four weeks before the expiration of the term of stay. The renewal application will be considered only if the applicant continues to meet the work permit eligibility criteria as discussed above. In case the work visa renewal application is approved, the extension of stay will be based on the 2 to 2-3 years period or in accordance with the duration of your employment contract, whatever is shorter.

Change of Employment

With the professional employment scheme in place employment permit is valid only for the specific employer and it is not transferable. Changing jobs requires the applicant to make an application to the immigration department, by completing “Application for Change of Employment” form. After approval, the applicant has to hand over his/her current work permit and get the new one.

Dependant Visa for Family

Those who apply for the work permit under the scheme will be granted the opportunity to let their family members (their spouse and unmarried dependent children under 18 years old) be with them in Hong Kong to feel a closer family bond. An application on the family member’s dependent visa is the only way to achieve this. Being the dependant’s length of stay is directly related to the principal’s length of stay in Hong Kong and the dependant visa holders are allowed to take up any employment or study as required. 

Permanent Residence

If you have been given the work visa of employments for professionals and you have lived in Hong Kong for the continuous period of 7 years, it is only then that you are eligible to apply for Permanent Residence, also commonly known as “Right of Abode” in Hong Kong.
